Terms of Service
These Terms of Service ("Terms") govern your use of breezie.ai and the applications and services that Breezie LLC ("Breezie", "we", "us") operates or publishes (together, the "Services"). By using the Services you agree to these Terms. Individual applications may add supplemental terms, which apply in addition to these.
1. Eligibility and accounts
You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Services, and at least 18 to make purchases. You are responsible for your account credentials and for activity under your account. Provide accurate information and keep it current.
2. Your content
You keep ownership of the content you post or upload. You grant Breezie a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display that content as needed to operate and improve the Services, including showing it to other users where you have chosen to make it public. You are responsible for having the rights to anything you post.
3. Acceptable use
Do not use the Services to: break the law; infringe others' rights; post content that is illegal, harassing, hateful, sexually explicit involving minors, or that promotes violence; impersonate others; distribute malware; scrape or overload the Services; or interfere with other users. We may remove content and suspend or terminate accounts that violate these Terms.
4. Purchases, points, and payments
Some applications offer paid features, including tips, donations, unlockable content, subscriptions, and in-app balances ("points"). Prices and terms are shown at the point of purchase. Payments are processed by third-party providers subject to their own terms. Points have no cash value except where an application expressly allows withdrawal of eligible balances; promotional points may expire. Except as required by law or stated in an application's refund policy, purchases are final.
5. Creators and payouts
Where an application lets you receive tips, donations, or other earnings, payouts are made through a third-party payment platform and require identity verification and tax information as that platform and applicable law require. You are responsible for taxes on your earnings.
6. Intellectual property
The Services, including software, design, and trademarks, are owned by Breezie or its licensors and protected by law. Except for the rights expressly granted in these Terms, no license is granted.
7. Third-party services
The Services may link to or integrate third-party services (payment processors, app stores, identity providers). Your use of those services is governed by their terms, and Breezie is not responsible for them.
8. Termination
You may stop using the Services or delete your account at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue a Service, with notice where practical. Sections that by their nature should survive termination do so.
9. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law, Breezie disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, Breezie will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Breezie's total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or US$100.
11. Indemnity
You will defend and indemnify Breezie from claims arising out of your content, your use of the Services, or your breach of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court.
13. Changes
We may update these Terms. We will post the revised Terms here with a new effective date and, for material changes, notify you through the Services. Continued use after the effective date means you accept the revised Terms.
